21st Century Commercial Leasing Done Right

Traditionally commercial leasing has been initiated with the retention of the real estate agent to commence the search for appropriate commercial lease space. It is an approach that companies and business people have undertaken for countless years, nevertheless this does not mean it is the best approach, especially given today’s underlying relationships in the commercial leasing sector. The stark reality is that this traditional approach is rarely, if ever, in the best interests of the prospective lessee, as it is not designed with intention of primarily advancing the lessee's business interests (which should be the case).

It is for that very reason, that in our professional opinion and based upon our considerable experience in the commercial leasing field, that companies and business people looking to lease commercial space in Toronto and the surrounding area, need to retain the services of dedicated legal counsel before undertaking any action towards searching for commercial space or retaining the services of a real estate agent. For when it comes to commercial leases, there is really only one professional involved in the process who is absolutely committed to your interests, and your interests alone, and that is your leasing lawyer. The obligation to you alone sets the lawyer apart from the other professionals involved in the real estate transaction, for there is no commercial interest with the landlord or any capacity to pursue such a relationship. Instead, the prospect of such is severed upon the retention of the law firm and the commitment is absolutely and unwavering to the business client (naturally, subject to legal, professional and ethical responsibilities).

As such, your business lease lawyer should be retained BEFORE you look to hire a real estate agent and BEFORE you negotiate any terms related to the prospective lease and ABSOLUTELY BEFORE you sign any offer to lease or intent to lease. By waiting to introduce the right lawyer to the lease search until after these milestones have been passed, your company will not be saving money, but will instead typically have a far more disadvantageous lease agreement, at typically higher cost (with respect to both base costs and hidden costs). As such, it makes considerable sense to inquire as to the potential contributions realizable from retaining the appropriate legal counsel at the very outset of your pursuit of commercial lease space in metropolitan Toronto and the surrounding territory.
